Privacy policies are rarely chart-toppers, but this one has an important job: explaining what information is processed when you visit the Moonsong website or subscribe to Moonsong news.

The short chorus is simple: we collect very little, we do not sell personal data, and we do not build advertising profiles. We use privacy-conscious website analytics and an email service that helps us deliver the newsletter you asked for.

Jivalabs d.o.o. operates the website and uses several names for different parts of the project:

  • Moonsong is the game franchise and the main public-facing brand.

  • Moonsong Studio is the creative studio name used for the project.

  • Jivalabs Games is the game-publishing label of Jivalabs d.o.o.

These names do not represent separate legal entities. When this policy says “we”, “us” or “Moonsong”, it means Jivalabs d.o.o. acting through these brands.

2. What This Policy Covers

This policy covers personal data processed through the public Moonsong website, including:

  • ordinary website visits;

  • privacy-conscious website analytics;

  • the embedded Moonsong newsletter form;

  • newsletter delivery and engagement statistics; and

  • messages sent directly to info@moonsong-game.com.

This policy does not cover a future Moonsong game, Steam release, game account, purchase, multiplayer service or in-game telemetry. Those services are not currently provided through this website and may have separate terms or notices when the beat finally drops.

3. Information Processed When You Visit

Like every website, our server must briefly process technical information so it can send the requested page to your device. This may include your IP address, browser type, device information, requested page, time of request and basic security information.

We do not retain identifiable standard access logs for routine visitor analysis. Technical information may be processed transiently for delivery and security, while operational statistics are kept only in aggregated form.

We also use self-hosted Matomo analytics to understand whether visitors can find the right pages, where they lose the rhythm and which content deserves an encore. Depending on your consent choices, Matomo may process:

  • pages viewed and actions performed during a visit;

  • visit timestamps and approximate visit duration;

  • referring page or campaign information;

  • browser, operating system, device type and screen information;

  • approximate geographic information derived from an anonymised IP address; and

  • a first-party visitor or session identifier when analytics cookies are accepted.

Matomo is configured with IP anonymisation, cross-device tracking disabled and browser “Do Not Track” signals respected. We do not intentionally connect Matomo visits to a named person or a website account, because this website has no user accounts. Matomo may still display the sequence of actions belonging to one pseudonymous visit; that is visit analysis, not a dossier with your name on the cover.

4. Newsletter Data

When you subscribe to Moonsong news, we ask only for your email address. We use double opt-in, so the subscription becomes active only after you confirm it through the message sent to that address.

To operate the subscription and demonstrate that it was requested, we and our email provider may also process:

  • subscription and confirmation timestamps;

  • subscription source and consent records;

  • delivery, bounce and unsubscribe status;

  • newsletter opens and link clicks;

  • approximate location, browser, device and similar technical information connected with email delivery or engagement; and

  • information needed to prevent duplicate subscriptions, spam or misuse.

Newsletter engagement data helps us understand whether an announcement was useful or whether it landed with the elegance of a drummer falling off the stage. It is not used for third-party advertising, cross-site profiling or automated decisions about you.

You will receive only news connected with the Moonsong franchise. You can unsubscribe at any time using the link included in every newsletter.

5. Why We Process Personal Data

We process personal data for the following purposes and legal grounds:

  • Delivering and securing the website: our legitimate interests in providing a stable, safe and functional website.

  • Website analytics: your consent where analytics cookies or consent-based tracking are used; for strictly limited cookieless or aggregated statistics, our legitimate interests where applicable law permits that processing.

  • Newsletter subscription, delivery and engagement measurement: your consent.

  • Answering direct messages: taking steps at your request and our legitimate interests in communicating with visitors.

  • Legal compliance and protection of rights: compliance with legal obligations and our legitimate interests in establishing, exercising or defending legal claims.

Where processing is based on consent, you may withdraw that consent at any time. Withdrawal does not make earlier lawful processing unlawful; it simply tells the music to stop from that point onward.

6. Cookies and Similar Technologies

We use a small number of technical, functional and analytics technologies connected with the cookie banner, self-hosted Matomo and the embedded MailerLite subscription form.

7. Who Helps Us Keep the Show Running

We may share personal data only with service providers that need it to perform services for us, under appropriate confidentiality, security and data-protection obligations.

Matomo is hosted by us, so website analytics data is not sent to Matomo as an external analytics provider.

MailerLite processes subscriber data on our behalf to host the embedded form, manage double opt-in, send newsletters and provide delivery and engagement reports. For customers in the European Economic Area, MailerLite states that services are provided by MailerLite Limited in Ireland and subscriber data is stored in the European Union. MailerLite may use approved sub-processors and applies lawful safeguards where an international transfer is required.

We may also disclose information where required by law, a competent authority or a court, or where reasonably necessary to protect the website, our rights or other people.

We do not sell personal data. We also do not share it for cross-context behavioural advertising.

8. International Visitors and Transfers

Moonsong has an international audience, while Jivalabs d.o.o. is established in Slovenia and primarily processes data under Slovenian and European Union data-protection law.

Where a service provider processes data outside the European Economic Area, we use or require an appropriate legal transfer mechanism, such as an adequacy decision, approved standard contractual clauses or another safeguard recognised by applicable law.

9. How Long We Keep Information

  • Transient server information: processed only as needed to deliver and secure the website; routine identifiable access logs are not retained for visitor analysis.

  • Matomo data: retained only for as long as reasonably needed to compare website trends and improve the site, after which older information is deleted or kept only in aggregated form.

  • Newsletter data: retained while you remain subscribed. After you unsubscribe, we may keep a minimal suppression record so we do not accidentally add you back, and retain limited evidence of consent where needed for legal accountability.

  • Direct correspondence: retained for as long as needed to answer the message, manage the relationship and meet legal or record-keeping obligations.

10. Younger Visitors

Moonsong is made for a broad audience, including children and teenagers. Reading the public website does not require an account or the submission of personal data.

The newsletter is optional. If you are below the age at which you may validly give data-protection consent in your country, please ask a parent or legal guardian to authorise the subscription. In Slovenia, that consent threshold is generally 15 years of age. Below that age, a parent or legal guardian should authorise the subscription.

We do not knowingly seek personal data from a child who cannot validly consent without the required authorisation. A parent or guardian who believes a child subscribed without valid permission may contact us, and we will review and delete the information where appropriate.

11. Your Privacy Rights

Depending on the law that applies to you, you may have the right to:

  • ask whether we process your personal data and obtain access to it;

  • correct inaccurate or incomplete information;

  • request deletion or restriction of processing;

  • receive certain data in a portable format;

  • object to processing based on legitimate interests;

  • withdraw consent at any time;

  • opt out of a sale or sharing of personal data where local law provides that right — although we do not sell personal data or share it for behavioural advertising; and

  • lodge a complaint with a competent data-protection authority.

To exercise a right, email info@moonsong-game.com. We may need enough information to verify that the request concerns you, but we will not ask for a full orchestral score when one note is enough.

In Slovenia, the competent supervisory authority is the Information Commissioner of the Republic of Slovenia.

12. Security

We use reasonable technical and organisational measures designed to protect personal data against unauthorised access, loss, alteration or disclosure. No online system can promise perfect security, but we aim to keep every door locked and every backstage pass checked.

13. Automated Decisions

We do not use personal data collected through this website to make decisions that produce legal or similarly significant effects about you. No algorithm decides whether you are worthy of the chorus.

14. Changes to This Policy

We may update this policy when the website, our tools or applicable law changes. The current version and its update date will always be published on this page.
