Welcome to the Moonsong website. These Terms of Use are the house rules for visiting and using the site. They are written in plain English because nobody should need a legal drum solo just to read about a game.
By accessing or using the website, you agree to these Terms. If you do not agree, please stop using the site.

Jivalabs d.o.o. uses Moonsong as the franchise brand, Moonsong Studio as the creative studio name and Jivalabs Games as its game-publishing label. These are brands of Jivalabs d.o.o., not separate legal entities.
2. What These Terms Cover
These Terms apply only to the public Moonsong website and the information currently available on it.
They do not govern a future Moonsong game, Steam release, demo licence, purchase, game account, multiplayer service or community platform. Those services may come with their own terms, end-user licence agreement or privacy notice when they become available.
3. What You Can Do Here
You may browse the website, read its public information and use the newsletter form according to these Terms and applicable law.
You may also link to a public page, provided the link is fair, lawful, does not suggest an endorsement that does not exist and does not present the website inside a misleading frame.
The website currently does not provide user accounts, purchases, uploads, comments or a playable online game.
4. Stay on Beat: Acceptable Use
Please do not use the website in a way that is unlawful, harmful or disruptive. In particular, you may not:
attempt to gain unauthorised access to the website, server, administration area or connected systems;
introduce malware, malicious code, excessive automated traffic or anything designed to interfere with normal operation;
bypass access controls, security measures, rate limits or technical restrictions;
scrape, crawl, harvest or systematically copy substantial parts of the website without our prior written permission, except where applicable law expressly permits it;
reverse engineer or probe non-public website components except where that restriction is prohibited by mandatory law;
impersonate Jivalabs d.o.o., Moonsong, Moonsong Studio, Jivalabs Games or anyone connected with the project;
use the website or its content to mislead, defraud, threaten or harm another person; or
use automated tools in a way that places an unreasonable load on the website. Robots also need rhythm.
5. Content and Intellectual Property: Look, Don’t Lift
Unless stated otherwise, the website and its contents — including text, names, logos, artwork, illustrations, screenshots, graphics, music, audio, video, designs, code and the overall presentation — are owned by Jivalabs d.o.o. or used with permission from their respective rights holders.
All rights are reserved. Merely placing something on the website does not release it into the public domain or grant a licence to reuse it.
You may view the website for personal, non-commercial informational purposes. You may not copy, reproduce, republish, distribute, modify, translate, sell, license, publicly perform, publicly display, create derivative works from or otherwise reuse website material without prior written permission, unless a specific item clearly states otherwise or mandatory law permits the use.

6. Names, Logos and Marks
Moonsong, Moonsong Studio, Jivalabs Games, Jivalabs and associated names, logos, characters or visual identities may be trademarks, trade names or protected branding of Jivalabs d.o.o. or its licensors.
You may not use them in a way that suggests sponsorship, partnership, official status or endorsement without written permission.
7. Newsletter
The newsletter is optional and is intended only for Moonsong news. Subscriptions use double opt-in, and every newsletter includes an unsubscribe link.
You must submit an email address that you are authorised to use. Do not subscribe another person without permission; surprise newsletters are not a recognised form of percussion.
Personal data connected with the newsletter is handled as explained in our Privacy Policy.
8. Younger Visitors
The public website is intended for a broad audience and may be read by children and teenagers. No account is required to browse it.
If you are a minor, please involve a parent or legal guardian before providing personal data where your local law requires their authorisation. Parents and guardians are encouraged to help younger visitors understand online privacy and these Terms.
9. Third-Party Links
The website may occasionally link to a third-party website for additional information. A link does not mean that we control, endorse or accept responsibility for that third party’s content, security, availability or privacy practices.
Third-party sites play by their own rules, even when they are in the same musical genre.
10. Accuracy, Changes and Availability
We try to keep the website accurate and useful, but game projects evolve. Concepts, artwork, features, release plans, platforms, dates and other information may change, be delayed or be removed.
Unless we clearly state otherwise in a binding written agreement, website content is provided for general information and does not create a promise that a particular game, feature, release date, platform or commercial offer will become available.
We may update, suspend or discontinue any part of the website without notice. We do not guarantee that the site will always be available, uninterrupted, secure or free from errors.

To the fullest extent permitted by applicable law, the website and its content are provided “as is” and “as available”, without express or implied warranties.
This does not exclude any warranty, guarantee or consumer protection that cannot legally be excluded in your country.
12. Limitation of Liability
To the fullest extent permitted by applicable law, Jivalabs d.o.o. and persons working on the Moonsong project will not be liable for indirect, incidental, special or consequential loss arising from the use of, or inability to use, the website.
Nothing in these Terms limits or excludes liability where doing so would be unlawful, including liability that cannot be excluded under mandatory consumer law or liability for intentional misconduct where applicable.

14. Changes to These Terms
We may update these Terms when the website, project or law changes. The current version and update date will be published on this page.
Continued use after an update means the revised Terms apply from that point, subject to any mandatory notice or consent requirements under applicable law.
15. Governing Law and Courts
These Terms are governed by the laws of the Republic of Slovenia, without regard to conflict-of-law principles.
The courts with jurisdiction in Slovenia will have jurisdiction over disputes, except where mandatory law gives a consumer the right to bring or defend proceedings in another court, including the courts of the consumer’s place of residence.
Nothing in these Terms removes rights that cannot be waived under the mandatory law applicable to you.
16. If One Part Misses a Note
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue to apply. The invalid part will be interpreted or replaced as closely as legally possible to preserve its intended purpose.
